THETA, TN – “HERR” David L. Howard would have you believe that it’s “Kumbaya” time at the 2013 Celebration, and that Inspections are going “swimmingly” with the dqps and vmos are all joining hands and playing ring around the rosie.
NOTHING could be further than the truth.
After the Tuesday night performance, the “Herr” Man put out that SHOW HIO (Plaintiff in the suit vs USDA) has inspected 1,340 horses and found 27 violations on 26 horses.
Then “Herr” spun the WHOPPER of WHOPPERs. He said that one horse had two violations so – drum roll – Twenty-six horses found in violation out of 1,340 is 1.9%.

Herr conveniently left out that 70 HORSES through Tuesday night is the correct number when you combine the SHOW HIO dqp numbers with the USDA VMO violations. The actual number of tickets written could be higher regarding the 70 horses, because there could be multiple violations on each horse. For example, “Honors”, the “Saviour Horse”, had scar rule infractions on BOTH front feet AND a sore on one foot and inconclusive sore on other one. Honors came real close to being bilaterally sore (TWO FOOTER). Nephew Eugene happened to be peeking into the Inspection Area and witnessed the Celebration man in the “Chef” hat saying some mighty strong things to a USDA official about “Honors” being turned down. Nephew Eugene will have more on this later.
Now, the story that “Herr” Howard desperately does not want told is the following one.
There is a record number of the sore horses that the Trainers are “scratching” because they are afraid to take them up to inspection because if they are found sore, they (Horse, Trainer, Rider, Owner) will ALL feel the “bite” of the new federal regulations called the Mandatory “Minimum Penalties”. NOTE: “Herr” Howard’s Celebration/SHOW HIO spent $500,000 fighting the USDA’s in federal court before getting “SLAM DUNKED” by the Judge on July 29, 2013. Then the Celebration adopted the MP after close of business on Monday,August 19 before the start of the Celebration at 9:00 a.m. on Wednesday, August 21.
HERE ARE THE IMPORTANT NUMBERS
On the first Thursday night, 198 entered and 149 showed – 75%. Remember, this was the night that PSHA Chairman got in a verbal dust-up with the USDA VMO over two of his horses receiving HPA violations. Dotson ended up resigning on this Monday as PSHA Chair and packed up his camper, saying he was tired and mad, and hauled off back up to Kingston, TN where he is now eating Cheetos. Also on Thursday night, some of the King Bee Jimmy McConnell’s squad also picked up a couple of HPA violations.Now remember, The Celebration on the Monday, Aug. 19, 2013, to the shock of the Trainer Brethren “accepted” the federal regulations known as the Mandatory “Minimum Penalties”.
Reality set in after Thursday night went down, and the Trainer Boyz went into a “Tizzy”. Some of them had a running hissy fit that resembled a bottle rocket barrage going off. In 1988, when the lights went out at the Trainers Show, they were going to “strike”.
So 25 years later, they didn’t exactly strike, but what they did do was similar in that they refused to bring horses up to be inspected because they were “skeered” that they would be found sore and suffer the serious penalties provided in the new federal regulations. The Trainer Boyz figure they could be out of business in short order – so being between a rock and a hard place – they just decided to keep the horses in the stalls and not risk it.

Friday Night – 201 entered and 128 showed – 64%.
Saturday Night – 200 entered and 128 showed – 64%.
Sunday Night – 222 entered and 153 showed – 69%.
Monday Night – 185 entered and 110 showed – 59%.
Tuesday Night – 210 entered and 128 showed – 61%
Wednesday Night – 241 entered and 133 showed – 55%

So – for the Thursday, Friday, Saturday, Sunday, Monday, Tuesday and Wednesday NIGHT CLASSES (primarily Pads and Chains):
440 horse not taken to inspection – because the Trainers are afraid they will be found SORE and have to face the Mandatory “Minimum Penalties”.
Average of only 65% of Horses entered being led up to Inspection by Trainers from Thursday, Aug 22 through Wednesday Aug 28.
That means 440 HORSES “SCRATCHED” OR NOT BROUGHT UP TO BE INSPECTED.
And that should tell you that large a number of horses are not being brought up to be inspected because they would be found SORE and in violation of the HPA.
And that through seven days of the 2013 Celebration is the story.
