Dear Mr. Shea,
FOSH is writing because it is deeply concerned that the USDA will certify PSHA or Independent Inspection Services, LLC HIO,  as an HIO.    FOSH strongly believes that no organization that has Board members with HPA violations should be certified as an HIO.    To do so would be akin to a bank having convicted embezzlers on its Board or a law enforcement group hiring drug pushers.    Their records are below:

The conflicts of interest are so apparent it is no wonder that the OIG Report recommended abolishment of the HIO system.    I hope APHIS heeds their recommendation.
 
We note that there is concern in the Performance Horse industry that there will not be an HIO to inspect performance horses if SHOW is decertified and PSHA or some entity related to PSHA is not certified.    It is our opinion that IWHA and DQP Services are available to inspect padded horses; however, I also counter with the fact that not having a Performance Horse HIO is NOT the USDA’s problem nor of their making.    This is NOT the problem of the compliant HIOs nor of their making.    It is NOT the job of the USDA to prop up the Performance Horse industry which is mostly composed of repeat HPA violators as evidenced by the chart.    The big lick industry is like dog fighting””it is built entirely on animal abuse and has no redeeming value  in the agricultural industry or anywhere else.
 
The problem of not having a certified HIO acceptable to the Performance Horse industry to inspect Performance Horses falls squarely upon its own back.    This issue reflects everything that is dysfunctional with that industry and has made it so very difficult for the USDA to police.    There are two red flags:    The Performance Horse industry is incapable of operating an HIO that is compliant with the regulations (SHOW), and it is also incapable of forming an HIO with principals that have zero HPA violations or zero USDA Letters of Warning.    Having no one available from the Performance Horse industry with zero violations fully demonstrates that the industry is entirely based upon the abusive act of soring””they ALL do it.    The USDA should not be saving the Performance Horse industry when it is obvious the entire industry is founded and operates on the abuse of soring.    Soring cannot and should not be regulated by the USDA””it should be stopped.
 
If USDA enforcement means that Performance Horse HPA violators cannot exhibit, so be it because it means that the USDA is fully enforcing the HPA.    The USDA is supposed to enforce the HPA and not assist the limping and sore Performance Horse industry to stay alive.    The USDA is not killing the Performance Horse industry””they are pulling the trigger on themselves.    Please do not enable them.
