PANAMA CITY BEACH, FL –  The Panama City Beach Convention and Visitors Bureau and Bay County Tourism Development Council*,  in a Combined Board Meeting held on January 12, 2016,   apparently gave $25,000.00 of taxpayers money to the 2016 “Gulf Coast Charity Trainers Horse at the request of Horse Show founder Ms. Martha “Sister” Blackmon Milligan.

Complaint

There is reason to believe that the Respondents named herein have violated the Horse Protection Act, as amended and supplemented (15 U.S.C. §§ 1821 et seq.) (Act), and the regulations promulgated thereunder by the Secretary of Agriculture (9 C.F.R. §§ 11.1 et seq. (regulations). Therefore the Administrator, Animal and Plant Health Inspection Service (Complainant), pursuant to the rules ofpractice applicable to thi1’l proceeding (7 C.F.R. §§ 1.130 et seq.) (rules ofpractice) issues this complaint alleging the following:

1. Respondent J. W. “Dick” Peebles is an individual who resides in Tennessee. The Respondent’s mailing address will not be provided in the complaint to protect his privacy, but will be provided to the Hearing Clerk’s Office, United States Department ofAgriculture, for the purpose ofservice ofthis complaint and future documents. At all times mentioned herein the Respondent J. W. “Dick” Peebles was the trainer ofthe horse known as “Jose’s Night Train.”

2. Respondent Martha “Sister” Blackmon-Milligan is an individual who resides in Florida. The Respondent’s mailing address will not be provided in the complaint to protect her privacy, but will be provided to the Hearing Clerk’s Office, United States Department of Agriculture, for the purpose of service of this complaint and future documents. At all times mentioned herein the Respondent Martha “Sister” Blackmon-Milligan was the owner of the horse known as “Jose’s Night Train.”

3. On or about April26, 2013, Respondent J.W. “Dick” Peebles, showed or exhibited the horse known as “Jose’s Night Train” as entry number 270 in class number 33, in the 15th Annual Gulf Coast Charity Trainer’s Show held in P;mama City, Florida.

4. On or about April 26, 2013,  Respondent Martha “Sister” Blackmon-Milligan allowed the showing ofthe horse known as “Jose’s Night Train” as entry number 270 in class number 33, in the 15th Annual Gulf Coast Charity Trainer’s Show held in Panama City, Florida.

5. On or about April 26, 2013, Respondent Martha “Sister” Blackmon-Milligan showed or exhibited the horse known as “Jose’s Night Train” as entry number 270 in class number 33, in the 15th Annual Gulf Coast Charity Trainer’s Show held in Panama City, Florida.

1. On or about April 26, 2013, Respondent J.W. “Dick” Peebles violated section 5(2)(A) ofthe Act (15 U.S.C. § 1824(2)(A)) and 9 C.F.R. § 11.3, in that Respondent showed or exhibited the horse known as “Jose’s Night Train” as entry number 270 in class nUm.ber 33, in the 15th Annual Gulf Coast Charity Trainer’s Show held in Panama City, Florida, while the horse was sore.

2. On or about April 26, 2013, Respondent Martha “Sister” Blackmon-Milligan violated section 5(2)(D) of the Act (15 U.S.C. § 1824(2)(D)) and 9 C.P.R. § 11.3, in that Respondent ·allowed the showing of the horse known as “Jose’s Night Train” as entry number 270 in class number 33, in the 15th Annual Gulf Coast Charity Trainer’s Show held in Panama City, Florida, while the horse was sore.
3. On or about April26, 2013, Respondent Martha “Sister” Blackmon-Milligan violatedsection 5(2)(A) of the Act (15 U.S.C. § 1824(2)(A)) and 9 C.P.R. § 11.3, in that Respondent showed or exhibited the horse known as “Jose’s Night Train” as entry number 270 in class number 33, in the 15th Annual Gulf Coast Charity Trainer’s Show held in Panama City, Florida, while the horse was sore.

By reason ofthe facts alleged in paragraphs I and IT ofthis complaint, there is reason to believe that the Respondents have violated the Act and the specified regulations promulgated thereunder.

WHEREFORE, this complaint shall be served upon the Respondents for the purpose of determining whether the Respondents have violated the Act and the regulations. Respondents shall have twenty (20) days after receipt ofthis complaint in which to file an Answer with the Hearing Clerk, Room 1031 – South Building, United States Department o f Agriculture, 1400 Independence Avenue, SW, Washington, DC 20250-9200, in accordance with the Rules of Practice governing the proceedings under the Act (7 C.P.R.§§ 1.130 et seq.). Allegations not answered shall be deemed admitted for the purpose ofthis proceeding. Failure to file an answer will constitute an admission o f all the material allegations in this complaint.

The Animal and Plant Health Inspection Service requests:

1. That unless the Respondents fail to file an answer within the time allowed, or file an answer admitting all the material allegations ofthis complaint, this proceeding be set for oral hearing in accordance with the Rules of .pPractice; and

2. That such order or orders be issued as are authorized by the Act and warranted under the circumstances includipg an order:

(a) Assessing civil penalties against the Respondents in accordance with section 6(b) ofthe Act (15 U.S.C. §1825(b)); and

(b) Disqualifying each Respondent for a specified period as provided in section 6(c) of the Act (15 U.S.C. §1825(c)) from (i) showing, exhibiting or entering any horse, or otherwise participating in any horse show or exhibition; and (ii) judging or managing any horse show, horse exhibition, horse sale or auction.

MS. MARTHA “SISTER” BLACKMON-MILLIGAN SUPPORTS CRIMINAL DEFENSE OF CONVICTED BIG LICK TRAINER MR. JAMIE LAWRENCE IN COLUMBIA, MAURY COUNTY, TENNESSEE ON FEB. 2, 2016

According to eyewitnesses, on Feb. 2, 2016,  Ms. Martha “Sister” Blackmon Milligan was in a Columbia, Maury County,  Tennessee Circuit Court Room actively providing support to the criminal defense of World Champion Big Lick Walking Horse Trainer Mr. Jamie B. Lawrence who was on trial for Aggravated Assault with a Deadly Weapon against Ms. Teresa Bippen, President of FOSH (Friends of Sound Horses).  The assault occurred when Ms. Bippen was exercising her constitutional right to free speech and protesting Big Lick Animal Cruelty at the Columbia Spring Jubilee Horse Show at the Maury County Park.  when Mr. Lawrence drove a dually pick up truck pulling a horse trailer at her which was witnessed by two law enforcement officers and captured on video.
