“The Flatters” Hold A Commanding 71% – 29% “COMMENT” Lead Over “The Lickers” With The Public Comment Period Ending On Wednesday, October 26, 2016

USDA – RIVERDALE, MD  – Coming down to the finish line of 11:59 p.m. on Wednesday,  October 26, 2016, approximately 71% of the 9,949 persons commenting on the USDA Proposed Regulation are FOR removing the “Pads and Chains” to abolish “Big Lick” Animal Cruelty.

If USDA Deputy Administrator Kevin Shea had not done two inexplicable things to incite the “Trotter”,Breeds (American Saddlebreds,  Morgan Horses,  Arabians,  Hackneys and others)  the number of FOR  Comments for the proposed Regulation would easily be over 85%.

After a quick flurry of Comments during July and August, the Licker opposition essentially died after September 3, 2016,  with Flatters with 84% (3,025) and Lickers 16% (654).

The 654 Licker Comments backs up what www.billygoboy.com has reported for a long time – the “Big Lick” Animal Cruelty folks, although few in number,   are holding the Tennessee Walking Horse breed hostage for:

  • Profit  (Getting Filthy Rich – Mr. David L. Howard)
  • Ego Aggrandizement  (Addicted LIcker Exhibitors)
  • Control  (Mr. David L. Howard & Mr. Steve Smith)
  • Making A Living For Their Families  (Trainer BOYZ)

These same folks have also damaged the wonderful community of Shelbyville,  Bedford County, Tennessee.    Mr. Hugh Jones, Publisher of the Rust Communication,  Shelbyville Times-Gazette would not allow this Ad to be run in the local newspaper.   The Rust Communications newspaper violates all standard of journalism ethics by not covering both sides of the story.

The Licker Plan at the 2016 Tennessee Walking Horse National Celebration (Aug. 25 – Sep. 3 Super Bowl) was to gather a massive number of AGAINST comments at the Tennessee Walking Horse National Celebration, but resolute opposition by CCABLAC (Citizens Campaign Against “Big Lick” Animal Cruelty animal welfare advocates protesting outside the gates of the 2016 Tennessee Walking Horse National Celebration largely dissuaded that. There has been no overwhelming wave of Licker “AGAINST” Comments gathered at the 2016 Celebration.

An older gentleman Celebration patron was solicited to do so, and he replied:

“I live close to here, and I have been coming here for a long time, and if I had anything else to do, I wouldn’t be here.   I am not going to do any Comment thing.”

USDA PROPOSED REGULATION TO HORSE PROTECTION ACT, AS AMDENDED. TO REMOVE “PADS AND CHAINS” TO ABOLISH “BIG LICK” ANIMAL CRUELTY

  • FOR                 7,407     71%
  • AGAINST         2,902    29%
  •                         9,949    Total

The Comment period started on July 26, 2016.

For about the first month, the Flatters held a commanding – 83% – 17%  edge over the Lickers with a total of 3,676 Comments.

Now,  with only three days ago,  the Flatters are ahead – 71% – 29% with a total of 9,706 Comments.

So what happened to cause the drop from 83% to 71%.

Or conversely, the increase from 17% to 29%.

The answer is USDA APHIS Administrator Kevin Shea clouded what should have been a straight forward proposition.   The Regulation published in the Federal Register on July  26, 2016,  contained the words “Related Breeds”,  rather than the names of the equine breeds which have a history of Animal Cruelty which were named in the proposed PAST ACT which include:

  • Tennessee Walking Horse
  • Racking Horse
  • Spotted Saddle Horse.

Then on September 22, 2016,  Aphis Administrator Kevin Shea made a bizarre untimely confusing “Clarification” which threw the “Trotter World” (American Saddlebred, Morgan Horses, Arabians, Hackney etc) into chaos.

Consequently there was an onslaught of “Trotter” Comments Against the proposed Regulation to remove the “Pads and Chains’ which would abolish the “Big Lick” Animal Cruelty.  The Trotters condemned the SORING, and said the Regulation should only be directed at the breeds with a history of animal cruelty, i.e., Tennessee Walking Horse, and not the “Trotters”.

Here are the numbers which confirm that from September 6 to September 30“Trotter” AGAINST Comments were almost 80%, and the Lickers were less then 3%.

Comments AGAINST from TROTTERS: 1,440   (78.4% of 1,440)
Comments AGAINST from LICKERS: 41  ( .028% of 1,440)


Of the 1,440 Against from Sep. 6 to Sep 30,  only 41 were LIckers – that’s less than 3% of the 1,440 “Against” Comments.

Of the 1,440 Against,  Trotters were 1,13078% of the 1,440 “Against” Comments – and the rest – 20% were non-specific “Against”.

In summary,   APHIS Administrator Kevin Shea did two things to incite the Trotters:

  •  Rather than make the Proposed Rule specific to Horse breeds with a history of Animal Cruelty such as Tennessee Walking Horse, Racking Horses, Spotted Sadle Horses,   Shea approved the insertion of the words “Related Breeds”.
  • Then on September 22, 2016,  Shea entered a confusing “Clarification” which limited Horses to a keg shoe

One wonders if APHIS Administrator Kevin Shea really wants the USDA Proposed Rule to remove the “Pads and Chains” and abolish “Big LIck” Animal Cruelty to be finalized.

And if he does,  he is showing a rather peculiar way of presenting things.

Nephew Eugene thinks that  USDA Secretary of Agriculture Tom Vilsack needs to call in APHIS Administrator Mr. Kevin Shea,  and tell him how the cow eats cabbage,  and then get on with publishing the Final Regulation in the Federal Register on or before November 28, 2016, which will remove the “Pads and Chains” and abolish “Big Lick” Animal Cruelty forever.

On September 3, 2016,  USDA APHIS Deputy Administrator Kevin Shea granted a 30 day extension to the July 26, 2016,  making a new Comment Deadline of October 26, 2016,  for “Comments” on the proposed rule, and then Shea inserted what may prove to be a “poison pill”.

It was a so called “CLARIFICATION” to the proposed Rule which read as follows:
