BillyGoBoy.Com Publisher Sues United States Department of Agriculture And USDA APHIS For Violating The Freedom Of Information Act (“FOIA”)

OXFORD, MS –  A “Freedom Of Information Act (“FOIA”) lawsuit was filed Thursday, February 1, 2018, in the United States District Court  for the Northern District of Mississippi  in Oxford, MS,  by Clant M. Seay, owner and publisher of the BillyGoBoy.Com website publication.

The FOIA Suit charges the Defendants, United States Department of Agriculture  and USDA APHIS,  with violating the Freedom Of Information Act (“FOIA”) by unlawfully refusing to provide alleged “Horse Soring” documents requested by the Plaintiff under “FOIA”.
The USDA APHIS is charged with enforcing the “Horse Protection Act”.

The Plaintiff asked U.S. District Court Judge Michael P. Mills to grant declaratory and injunctive relief in the case including:

  1. Order Defendant to provide access to the requested documents;
  2.  Expedite this proceeding as provided for in 28 U.S.C. § 1657
  3. Award Plaintiff costs and reasonable attorney’s fees in this action, as provided in5 U.S.C. § 552(a)(4)(E); and
  4. Grant such other and further relief as may deem just and proper.

The FOIA Complaint alleges that the Defendant USDA failed to provide information requested by Plaintiff Clant M. Seay under the Freedom Of Information Act (“FOIA”)  on September 8, 2017,  regarding the alleged “Soring” of 2017 World Grand Champion Tennessee Walking Horse National Celebration,  “Gen’s Black Maverick” on August 27, 2016, at the Tennessee Walking Horse Super Bowl (Celebration).
